Safety includes providing clear warnings about when and how to use the devices or medications, the proper dosages, any dangerous side effects, interactions, or uses, and other considerations.
    • Some of the types of drugs and medical devices that may cause harm if they’re defective include vaginal mesh products, pacemakers, joint implants, surgical tools, defibrillators, and stents.
  • Industrial products, workplace machines, and equipment. Construction companies, industrial companies, restaurants, and all types of businesses trust that the machines, equipment, and tools they use will be safe. Generally, workplace machinery is designed with OSHA standards in mind, but OSHA regulates employers’ workplace safety obligations, not general product approval.
    • These products include various vehicles (such as cranes, bulldozers, and forklifts), different types of equipment (such as ladders and scaffolds), ovens, chemicals, power tools, and many other products, depending on the type of business.

Since Massachusetts does not recognize a separate strict-liability tort for product defects, most product liability claims are based on breach of warranty and negligence.

Breach of warranty claims

We generally file claims against the manufacturer on the basis that the product breached an express written warranty or an implied warranty that the product would work. Manufacturers often provide express warranties (sometimes for an additional cost) about how long their product will work and the types of things/benefits their product provides. Massachusetts law provides that merchants (the sellers of the products) grant to buyers and renters of the product a warranty that the product is “merchantable.” Merchantable has many definitions, including that the product is “fit for the ordinary purposes for which such goods are used.”

We work to show which warranties applied to your product, how the warranties were breached, and what injuries (including death) the breaches caused.

In breach of warranty claims, you also might see:

  • Design defects. Before manufacturers begin to build any product, they need to use software, industry protocols, cost analysis, safety protocols, and other methods to ensure that their product is safe. We work with experts who can review what design methods were used, which ones were missed, what safer designs were available, and the known risks of the design.
  • Construction defects. We hold manufacturers accountable if they use substandard parts and improper methods to construct their products.
  • Marketing defects. We hold manufacturers accountable if they fail to provide warnings about known risks and dangers or if the instructions on usage are not clear. Warnings include labels on the product or instructions in the marketing materials. Examples of failure to warn include stating any known side effects of a drug or the electrical risks for improper use of certain power tools.

Negligence claims

We work with experts to show that the manufacturer failed to test, design, construct, and market the products in accordance with acceptable industry standards. This type of product liability claim does require showing that the manufacturer was liable/at fault for your injuries. Generally, we work with experts to show that the manufacturer failed to comply with industry protocols and standards for safety.
