Does Massachusetts have a slip and fall law?

Generally, the various case decisions of Massachusetts provide that accident victims can file a premises liability claim against a property owner if the property owner breaches their duty of care and that breach is the proximate cause of the victim’s injuries.

The duty of care depends on why you or your child is on the property of another person or business:

  • Invitees: Invitees include customers and visitors who are invited by a store owner, a restaurant, a hotel, or any for-profit or nonprofit enterprise to walk on the property, for the benefit of the owner. Property owners have a duty to take reasonable steps to become informed (usually, through routine inspections) about possible dangers and respond to known dangers.
  • Licensees: These are lawful visitors who enter with permission but not for the owner’s benefit (e.g., social guests). Property owners must warn them of known dangers but have no duty to routinely inspect for hazards.
  • Trespassers: Trespassers do not have the right to be on the property of another. Still, property owners may be liable if they intentionally create conditions to harm trespassers. Property owners may be required to protect children from hazards that could foreseeably attract them, such as pools or construction sites, even if the child is technically trespassing. A common example includes a child who is attracted to a swimming pool and who falls while walking around an unfenced swimming pool.

Property owners should routinely walk through their property (or hire companies to do the inspections) to look for possible dangers. If there is a danger, the property owner should set up signs and other warnings to alert customers and visitors to the dangers until the necessary repairs can be made.
